Expert Witness Testimony in Support of Trademark Infringement Claim

Hoffman Clark played a key role in securing a favorable settlement for a ranch in a $4.75 million trademark infringement dispute. The Plaintiff in the case, a ranching operation, retained Hoffman Clark to quantify damages in connection with its allegations that Defendant infringed Plaintiff’s trademarks by wrongfully promoting and selling goods and services using Plaintiff’s intellectual property.

The Plaintiff asked Hoffman Clark to conduct a comprehensive analysis in support of Plaintiff’s claim for a disgorgement of Defendant’s profits. Hoffman Clark successfully identified entire segments of the Defendant’s business which were financially benefiting from the use of Plaintiff’s intellectual property and quantified sales for a calculation of Defendant’s profits. Consequently, Hoffman Clark concluded that the Defendants sold approximately $5 million of goods and services using Plaintiff’s trademarks.

Hoffman Clark also responded to a report filed by Defendant’s expert. Ryan Clark, a partner at Hoffman Clark, offered rebuttal testimony regarding Defendant’s expert’s proffered methodology for determining Defendant’s alleged unlawfully obtained profits. Mr. Clark’s expert analysis and testimony helped refute the opposing expert’s flawed methodology, paving the way for a favorable settlement and substantial cost savings for the client.

Expert Rebuttal Testimony in Defense of Fraud and Breach of Contract Claims

Hoffman Clark was retained to provide rebuttal analysis regarding a damage claim exceeding $40 million related to fraud and breach of contract allegations. The Defendant, a company operating in the transportation and logistics industry, engaged Hoffman Clark to provide rebuttal analysis of the Plaintiff’s expert’s quantification of damages. Zachary Roseman, a Consulting Manager at Hoffman Clark, prepared a rebuttal report and offered deposition testimony responding to the opinions provided by Plaintiff’s damages expert, playing a critical role in a defense that resulted in a settlement before trial.

Expert Testimony in Class Actions

Hoffman Clark is engaged in an ongoing class action matter as an expert to analyze and quantify damages on behalf of a Plaintiff class comprising approximately 10,000 individual class members. The assignment includes processing data sets with varying formats containing millions of transaction records for the class members over the course of approximately 17 years. Hoffman Clark’s work requires analyzing the data, quantifying individual and class-wide damages, and presenting the calculations in an understandable format for the court’s consideration.
